Resale & Liquidation Coordination
Terms, Policies & Important Disclosures
B.T. Walker & Co. Estate Services provides professional resale and liquidation coordination to assist individuals, families, estates, executors, and authorized representatives with determining appropriate next steps for personal property.
Our role may include reviewing belongings, organizing and documenting selected property, researching resale opportunities, coordinating authorized sales, communicating with prospective buyers, and connecting clients with independent auctioneers, consignment businesses, appraisers, dealers, or other qualified professionals when appropriate.
The following policies are intended to provide transparency regarding the scope and limitations of our services.
1. Nature of Our Services
B.T. Walker & Co. provides resale and liquidation coordination services. Clients are paying for the professional time, organization, research, documentation, marketing, communication, and coordination involved in the resale process.
Unless specifically stated in a separate written agreement, B.T. Walker & Co. does not purchase the client's property and does not guarantee liquidation of an entire household.
2. No Guarantee of Sale
B.T. Walker & Co. cannot guarantee that any item will sell.
Successful resale depends upon numerous factors outside our control, including market demand, condition, desirability, location, seasonality, pricing, buyer availability, and general economic conditions.
Project fees compensate B.T. Walker & Co. for services actually performed and are not contingent upon every item being successfully sold.
3. No Guarantee of Value or Selling Price
Pricing recommendations, resale research, comparable sales information, and informal opinions provided by B.T. Walker & Co. are intended solely to assist with resale decisions.
They are not certified appraisals and are not guarantees of value or final selling price.
An item's eventual selling price may be higher or lower than anticipated, or the item may receive no acceptable offers.
4. Ownership of Property
All property remains the property of the client or estate until it is sold, transferred, donated, consigned, or otherwise disposed of with proper authorization.
Payment for B.T. Walker & Co.'s services does not transfer ownership of the client's belongings to B.T. Walker & Co.
5. Authority to Sell Property
The individual entering into an agreement with B.T. Walker & Co. must have appropriate authority to make decisions concerning the property involved.
When circumstances warrant, B.T. Walker & Co. may request documentation establishing the client's authority as an owner, executor, personal representative, trustee, agent, or other authorized representative.
B.T. Walker & Co. reserves the right to suspend services when ownership or authority is unclear.
6. Family, Personal & Sentimental Property
Clients are responsible for identifying belongings that are to remain with the family, be retained by the owner, or otherwise be excluded from resale.
B.T. Walker & Co. will make reasonable efforts to separate and protect property identified by the client as KEEP, FAMILY, or DO NOT SELL.
Clients should carefully review proposed resale property before authorizing its sale.
7. Authorization to Market & Sell
Property will not be intentionally offered for sale without appropriate client authorization.
When applicable, B.T. Walker & Co. may establish an asking price and a minimum authorized selling price with the client.
Offers below the authorized minimum will require additional client approval unless otherwise agreed in writing.
8. Resale Service Period
Resale coordination services are provided for the period specified in the client's service agreement.
Unless otherwise agreed, the standard active resale period is 30 days beginning after the selected property has been documented, prepared for resale, and authorized by the client.
Continued marketing beyond the agreed service period may require an extension or additional service agreement.
9. Unsold Property
Property that remains unsold at the conclusion of the agreed resale period continues to belong to and remain the responsibility of the client or estate.
Depending upon the circumstances, B.T. Walker & Co. may recommend reducing the price, extending the resale period, retaining the property, returning it to family, offering it through an independent auction or consignment business, donating it, or arranging appropriate removal.
B.T. Walker & Co. is not obligated to market an unsold item indefinitely.
10. Project Fees & Refunds
Project fees compensate B.T. Walker & Co. for professional services performed, including assessment, organization, research, documentation, preparation, marketing, communication, and coordination.
Accordingly, project fees are not refundable solely because one or more items fail to sell, provided the contracted services have been performed.
Any cancellation or refund relating to services not yet performed will be governed by the applicable service agreement.
11. Success Fees
When applicable, B.T. Walker & Co.'s success fee is charged only on property successfully sold through B.T. Walker & Co.'s direct facilitation.
No success fee is charged on unsold property.
The applicable percentage, method of calculation, payment terms, and definition of qualifying sales will be disclosed in the client's written service agreement before services begin.
12. Independent Auctions & Consignment Services
B.T. Walker & Co. may recommend that certain property be handled by an independent auctioneer, auction company, consignment business, dealer, or other resale professional.
These businesses operate independently and may charge their own commissions, buyer's premiums, transportation charges, storage fees, listing fees, or other expenses.
Such fees are separate from B.T. Walker & Co.'s service fees unless expressly stated otherwise in writing.
13. Independent Third-Party Providers
B.T. Walker & Co. may assist clients in locating or coordinating independent appraisers, auctioneers, movers, haulers, cleaners, contractors, consignment businesses, dealers, or other service providers.
Unless expressly stated otherwise, these providers are independent businesses and are not employees or agents of B.T. Walker & Co.
Their services are governed by their respective agreements, policies, insurance coverage, and professional obligations.
14. Professional Appraisals
B.T. Walker & Co. does not represent itself as a certified personal-property appraisal service.
When property appears potentially significant, unusual, specialized, or difficult to value, B.T. Walker & Co. may recommend evaluation by an appropriately qualified independent appraiser or specialist before the property is sold.
15. High-Value & Specialty Property
Jewelry, precious metals, fine art, coins, antiques, collections, vehicles, titled property, firearms, and other potentially high-value or specialized belongings may require additional documentation, evaluation, security, authorization, or professional assistance.
B.T. Walker & Co. reserves the right to require independent professional evaluation before assisting with the disposition of such property.
16. Firearms & Regulated Property
Firearms, ammunition, weapons, controlled materials, and other regulated property are not handled through B.T. Walker & Co.'s ordinary resale process.
When appropriate, clients may be referred to properly qualified or licensed professionals for evaluation, transfer, sale, or disposition in accordance with applicable law.
17. Right to Decline Property
B.T. Walker & Co. reserves the right to decline to market, transport, store, coordinate, or otherwise handle property that we reasonably believe to be illegal, unsafe, hazardous, contaminated, counterfeit, recalled, excessively damaged, improperly owned, subject to a dispute, regulated, or otherwise unsuitable for our services.
18. Condition & Description of Property
Most estate and household property is pre-owned and sold in its existing condition.
B.T. Walker & Co. will make reasonable efforts to describe property accurately and in good faith based upon available information.
Unless independently verified, B.T. Walker & Co. does not guarantee age, authenticity, provenance, functionality, condition, manufacturer, composition, or other characteristics of property.
19. Changes to Client Instructions
Clients may generally change their instructions regarding unsold property before a binding sale, transfer, consignment, or other commitment has been made.
Once property has been sold or B.T. Walker & Co. has entered into an authorized commitment concerning that property, the client's ability to withdraw the item may be limited.
Clients should promptly communicate changes in instructions.
20. Ownership & Family Disputes
B.T. Walker & Co. does not determine legal ownership or resolve disagreements among heirs, beneficiaries, family members, executors, trustees, or other interested parties.
If a dispute arises concerning ownership, authority, value, or disposition of property, B.T. Walker & Co. reserves the right to immediately suspend activity involving the disputed property until appropriate authorization or resolution is provided.
21. Property Access & Safe Working Conditions
Clients are responsible for providing reasonable access to the property during scheduled service periods.
B.T. Walker & Co. reserves the right to postpone, suspend, or discontinue work when conditions present a reasonable safety concern, including structural hazards, aggressive animals, severe infestation, biohazards, environmental hazards, or other unsafe conditions.
22. Photography & Documentation
Clients authorize B.T. Walker & Co. to photograph and document approved property as reasonably necessary for inventory, research, recordkeeping, valuation assistance, and authorized resale marketing.
Permission to photograph property for resale purposes does not automatically constitute permission to use photographs of the client's home or belongings for unrelated advertising or promotional purposes.
Separate authorization may be requested for such use.
23. Personal, Confidential & Sensitive Materials
Estate properties may contain financial documents, identification records, photographs, correspondence, medical information, tax records, electronic devices, military records, legal documents, or other sensitive materials.
When reasonably identifiable, B.T. Walker & Co. will separate potentially sensitive materials from ordinary resale property and seek client direction regarding their disposition.
24. Transportation & Storage
Transportation, delivery, shipping, removal, and storage are not automatically included in resale coordination services unless specifically stated in the client's agreement.
When property must be transported or stored, the parties will determine the appropriate arrangements and applicable costs.
Independent transportation or storage providers may be recommended when appropriate.
25. Loss, Damage & Insurance
B.T. Walker & Co. takes reasonable care when handling client property.
Responsibility for loss, accidental damage, theft, transportation, storage, or other risks will be governed by the applicable service agreement, circumstances of the loss, and applicable law.
Clients are encouraged to maintain appropriate insurance coverage for their property until ownership has legally transferred.
26. Third-Party Costs & Expenses
Unless expressly included in writing, B.T. Walker & Co.'s service fees do not include expenses charged by independent service providers.
Such expenses may include professional appraisals, auction commissions, consignment commissions, moving services, hauling, dumpsters, shipping, storage, cleaning, contractors, online marketplace charges, payment-processing fees, or similar costs.
Material third-party expenses should be authorized by the client before they are incurred.
27. Buyer Payments & Sales Records
Sales directly facilitated by B.T. Walker & Co. will be documented according to the procedures established in the client's service agreement.
Records may include the item sold, final selling price, applicable B.T. Walker fee, authorized expenses, and amount due to the client or estate.
Payment methods and settlement procedures may vary depending upon the type and value of property involved.
28. Cancellation or Termination of Services
Either party may terminate services according to the provisions of the applicable service agreement.
The client remains responsible for payment for services already performed and authorized expenses already incurred before cancellation.
Any prepaid amount attributable to services not yet performed will be handled according to the cancellation and refund provisions contained in the client's agreement.
B.T. Walker & Co. reserves the right to discontinue services when continued performance would be unsafe, unlawful, impractical, or inconsistent with the terms of the agreement.
29. Completion of Services
B.T. Walker & Co.'s resale coordination responsibilities conclude upon expiration of the agreed service period, completion of the contracted scope of work, disposition of the applicable property, or termination of the service agreement.
Unless another written arrangement has been established, responsibility for any remaining unsold property returns fully to the client or estate at the conclusion of services.
